Congressman Tony Wied (WI-08) has introduced the FIRE Act, legislation designed to block all federal, state, and local restrictions on firearm magazine capacity. The bill aims to protect gun owners’ rights nationwide by eliminating inconsistent laws and promoting a unified standard in line with Second Amendment freedoms.

WASHINGTON, DC (2-minute read) — Congressman Tony Wied of Wisconsin’s 8th District has introduced the Freedom from Improper Regulation and Enforcement (FIRE) Act, a bill that would outlaw any government-imposed restrictions on firearm magazine capacity—whether at the federal, state, or local level.

Wied, a strong proponent of the Second Amendment, says the measure is long overdue. “For too long, the federal government has infringed on Americans’ Second Amendment rights while maintaining a confusing, inconsistent system,” said Wied. “The FIRE Act ensures that law-abiding gun owners can access magazines of any size, no matter where they live.”

A Response to Patchwork Magazine Laws

Currently, gun owners face a confusing and often contradictory landscape when traveling or moving between states. Some states limit magazines to 10 rounds, others to 15, while some impose no limits at all. Violations can result in criminal charges, even for otherwise responsible gun owners.

The FIRE Act aims to fix that by enacting a nationwide standard that bans all magazine capacity limits.

According to a 2024 report from the National Shooting Sports Foundation (NSSF), over 973 million detachable magazines were produced between 1990 and 2021—and more than 718 million of those exceed a 10-round capacity. That data demonstrates that so-called “high capacity” magazines are, in fact, standard for most modern firearms.

Support from Pro-2A Lawmakers and Groups

The legislation already has the support of fellow Republican lawmakers, including Congressmen Tom Tiffany (WI-07), Mike Collins (GA-10), Dave Taylor (OH-02), Sheri Biggs (SC-03), and Russ Fulcher (ID-01).

Wied has also earned endorsements from top Second Amendment groups like the NRA, Gun Owners of America, and the Congressional Sportsmen’s Foundation.

Why Magazine Capacity Matters for Self-Defense

In real-world defensive scenarios, magazine capacity can be the difference between life and death. Defensive firearm encounters often involve multiple threats or poor lighting, and magazine changes in high-stress moments can lead to fatal delays. Many self-defense instructors recommend carrying standard-capacity magazines for this reason.

The FIRE Act doesn’t change who can own firearms—it simply ensures that those who legally carry and use them aren’t punished by arbitrary capacity limits.

Safety Tip: If you carry a firearm for self-defense, be sure you understand your state’s magazine capacity laws before traveling. Always verify reciprocity and transport laws to avoid legal issues.
